><p><strong>Qu\u00e8 \u00e9s la lleg\u00edtima?<\/strong><\/p>\n<p>Tal com regula el Codi Civil Espanyol: \u201cLleg\u00edtima \u00e9s la porci\u00f3 de b\u00e9ns que el testador no pot disposar per haver-la reservat la llei a determinats hereus, anomenats per aix\u00f2 hereus for\u00e7osos\u201d.<\/p>\n<p>No obstant aix\u00f2, no tots els espanyols estem subjectes al mateix r\u00e8gim de llegitimes, ja que aix\u00f2 dependr\u00e0 de la comunitat aut\u00f2noma a qu\u00e8 pertanyi el testador (o mort) segons el seu ve\u00efnatge civil, ja que hi ha unes comunitats aut\u00f2nomes que es regeixen per la regulaci\u00f3 com\u00fa i altres per regulacions pr\u00f2pies auton\u00f2miques.<\/p>\n<p>Per tant, aquesta lleg\u00edtima condiciona en redactar un testament i\/o acceptar una her\u00e8ncia, ja que el testador no \u00e9s lliure de deixar la totalitat del seu patrimoni a qui li plagui sin\u00f3 que, per llei, una part s\u00ed o s\u00ed anir\u00e0 als seus legitimaris .<\/p>\n<p>Aleshores no puc desheretar els meus fills?<\/p>\n<p>La llei d\u00f3na la possibilitat de desheretar, per\u00f2 en casos concrets i sempre que consti al testament i s&#8217;expressi la causa legal en qu\u00e8 es fonamenta.<\/p>\n<p>Un cop realitzat aix\u00f2, la prova del desheretament correspondr\u00e0 als hereus en cas que el desheretat negui la causa detallada al testament.<\/p>\n<p>Les causes de desheretament variaran en funci\u00f3 de la regulaci\u00f3 que s&#8217;hagi d&#8217;aplicar al cas concret (com\u00fa o auton\u00f2mica).<\/p>\n<p><strong>Rebuig generalitzat<\/strong><\/p>\n<p>Aquesta obligaci\u00f3 imposada per la legislaci\u00f3 actual, tant comuna com auton\u00f2mica, t\u00e9 cada cop m\u00e9s detractors, sobretot entre magistrats, notaris i advocats, ja que aquests estan a favor de la llibertat de testar, com podem comprovar de forma reiterada en articles i publicacions diverses.<\/p>\n<p>Per tant, caldr\u00e0 esperar que canvi\u00ef l&#8217;actual regulaci\u00f3 (que en alguns casos data del 1889) per adaptar-la a la realitat que ens envolta i, igual que en vida podem disposar lliurement dels nostres b\u00e9ns, en puguem
