Digital nomads visa: keys and requirements to obtain it

On the 21st of December, the Start-up act Law 28/2022 was approved. Within the regulations we find the new Digital Nomad Visa requirements.

 

WHO CAN APPLY FOR SPAIN’S DIGITAL NOMAD VISA?

This VISA is open to NON-EUROPEAN NATIONAL who work remotely for NON-SPANISH COMPANIES.

Self-employed freelancers with multiple clients, and remote workers employed by foreign companies can apply for the digital nomad visa.

IMPORTANT: The applicants would only be permitted to receive a maximum of 20% gross of their income from Spanish Company sources.

 

WHICH REQUIREMENTS DO THE APPLICANTS NEED TO TAKE INTO ACCOUNT?

  • Not residing illegally in Spain when applying for the NON RESIDENT VISA.
  • The employee must prove that they have worked for their company, or in the case of being a freelancer, have worked with their clients, for more than three months before applying. In the case of an employee of a foreign company, this must have been operational for a minimum of one year.
  • The applicant must prove that they have at least three years of work experience or that they have obtained a university degree or a professional certificate.
  • It is mandatory to contract private health insurance.
  • The applicant must earn a total income of 28.000€ per year in the current year.

 

CAN RELATIVES REQUEST IT?

Close relatives up to first degree (e.g. children and spouses), are allowed to join the visa holder in the country by providing proof of sufficient funds to be able to live independently.

Family units of two people, including the visa holder, must have an additional 75 per cent of the country’s monthly minimum wage (that would be €875/month); and 25 per cent (€292) would be added for each family member after that.

*the minimum wage in Spain is 1.080,00 euros

 

PERIOD OF TIME

Digital nomad visa would be valid for 12 months and could be renewed for up to five years.

It is possible to apply for a residency card to travel through the EU while living in Spain.

  

HOW TO APPLY FOR DIGITAL NOMAD VIDA?

Applicants need to apply to the consulate or embassy of Spain in their home country.
