Dear all,
We would like to start the November newsletter by joining in the consternation caused by the effects of the DANA and we send our encouragement to all those affected. In this regard, we are working on the assessment of the aid that has been approved in the two Councils of Ministers, and we are monitoring the measures for both residents and for companies and individuals who, although they are not residents, have been affected.
The newsletter also reminds us of the upcoming tax closure of Personal Income Tax and Corporate Income Tax and the end of the accounting moratorium, and reports, among other issues, on the latest news on information on sustainability and the latest tax proposals for 2025 pending approval. We also highlight a recent communication from the Treasury related to information returns and a summary of the legal and labour obligations of companies.
As always, we include some agenda events, publications and collaborations, in this case with the foundation ‘El somni dels nens’.

Highlights
/ Inland Revenue informs of the portal set up for informative returns
The Tax Administration is sending taxpayers an informative communication related to the annual information returns corresponding to the financial year 2024 and which will be filed as of 1 January 2025. Specifically, it provides information on the portal enabled for their filing and the technical requirements, as well as the procedures for their modification.
/ Final stretch to optimise the 2024 personal income tax and corporate tax bill
With just a few weeks to go until the end of the year 2024, taxpayers, whether individuals or companies, still have time to make some decisions to reduce their tax bill for the year, in Personal Income Tax and Corporation Tax, taking into account the new features of this year.
/ Summary of the legal and labour obligations of companies approved in recent years
Given the volume of legal and labour obligations approved in recent years, the implementation of which represents an increase in costs and administrative obligations for their management, we have prepared a document that recalls the main novelties..
/ End of the accounting moratorium
On 31 December, the accounting moratorium, a measure put in place so that many companies affected by COVID19 and subsequently by various geopolitical tensions, could continue their activity and avoid bankruptcy proceedings, will come to an end.
It is therefore important that the companies that benefited from this moratorium evaluate their financial statements to determine whether or not to take measures to clean up the balance sheet, file for bankruptcy or dissolve the company.
/ Corporate Sustainability Reporting Obligations
On 29 October, the Council of Ministers approved the Draft Law on Corporate Sustainability Reporting for submission to Parliament. The law represents a major step forward in the regulation of the current Non-Financial Reporting Statements (NFS) and is a transposition of the EU regulation on the subject.
In parallel, the Council of Ministers revised the financial thresholds to classify companies and facilitate their access to procedures and aid.
/ Tax proposals for 2025 under discussion, pending approval
The government is working on the draft law transposing the Directive on minimum corporate taxation of 15 per cent for multinationals and large national groups.
The same bill plans to include other tax measures in IS, IRPF and VAT.
/ Publication of the format of the invoicing programmes to comply with the Anti-Fraud Law (Veri*factu System)
The BOE has published the Ministerial Order with the conditions to be met by invoicing programmes for the self-employed and SMEs in order to comply with the Anti-Fraud Law (Veri*factu System), the deadlines for entry into force and the obligation to use QR codes, as well as the exceptions to compliance with the regulation.
/ Calendar of regional public holidays for 2025
On 18 October, the BOE (Official State Gazette) published the calendar of public holidays for the different autonomous regions and the cities of Ceuta and Melilla for 2025.
As you already know, you will have to add the two local holidays of the municipality where the company is located (or the one that has been agreed with the workers) to the holidays of your community.

/ UKI Annual & Emerging Leaders Conference 2024 Belfast
María José Moragas and Andrea Oró, from the Legal and Tax Areas, respectively, attended the DFK UKI Annual and Emerging Leaders Conference from 6 to 8 November.
One of the main topics on the agenda was the analysis of the accelerated process of digitalisation of companies. In particular, they learned how to improve internal processes, and especially how this process could be transformed into better service for customers and, as consultants and auditors, we can evaluate and help drive these processes.
They also studied and assessed different cases of mergers and takeovers, which have been on the rise in recent times in the sector and in the economy in general.

/ Bankruptcy Atlas 2024. Presentation

The Registry of Forensic Economists (REFOR) of the General Council of Economists of Spain (CGE) presents the Bankruptcy Atlas 2024, in an event in which bankruptcy statistical data and other variables related to the 2022 bankruptcy reform and the current geopolitical uncertainties at a global level that may have a direct effect on bankruptcy (active war conflicts, economic repercussions of the DANA, etc.) will be presented. The session will be addressed, among others, by our partner Valentí Pich as Chairman of the Board.

The General Council of Economists and various economists’ associations are organising an open virtual session on Thursday 21 November, from 16:00h onwards, on the aid and subsidies approved to deal with the effects of the DANA.

/ We participated in the drafting of the Quick Guide to Restructuring Plans
Our colleagues Josep Maria Bastons and Xavier Domènech, experts in restructuring and insolvency, have written the Quick Guide to Restructuring Plans, which they presented on 12 November in Madrid together with our partner Valentí Pich, in his capacity as president of the General Council of Economists, promoter of the publication (through its Register of Forensic Economists) together with the employers’ organisation CEOE.
It is a simple publication, in question-answer format, with which both organisations want to encourage companies to use restructuring plans, an agile procedure for resolving business crises. It is a dynamic publication that will be updated periodically.
/ We collaborate with the foundation ‘El somni dels nens’.
On 7 November we took part in a solidarity event organised by the foundation ‘El somni dels nens’, which works to make the dreams of sick children come true and to accompany their families by providing ‘breathing space’ and moments of joy. The event raised more than 61,000 euros.
A few days later, changes were inaugurated to ‘humanise’ the Neurology and Paediatric Pneumology consulting rooms at the Hospital de Sant Pau in Barcelona, thanks to the solidarity contributions of the foundation’s members and collaborators. ‘El somni dels nens’ is a reference entity for the valuable tasks they carry out. / Financial Observatory for the second quarter of 2024 – GDP could grow by 3% in 2024
The report, prepared by the Financial Commission and the Research Department of the General Council of Economists, points out that, with an expected rise in GDP of close to 3% at the end of 2024, Spain would, for yet another year, lead growth in the euro area. However, these forecasts could change downwards, due to the economic effects derived from the DANA, which took place after the presentation of the report.

/ Diari Ara. Interview with Valentí Pich on Sunday 3 November
Diari Ara interviewed our partner Valentí Pich, as president of the General Council of Economists, on Sunday 3 November. In the interview, Pich talks about the financing of the autonomous communities and the financing agreement for Catalonia, the Catalan Tax Agency and the claims of the employers’ association Foment del Treball for a better financing for Catalonia.
